1. Acceptance of Terms
By accessing and using APIVerve ("Service"), a trade name (doing business as) of EvlarSoft LLC ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provisions of this agreement. These terms apply to apiverve.com and all of its subdomains, including but not limited to dashboard.*, docs.*, studio.*, status.*, blog.*, static.*, and all API vertical sites. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
APIVerve provides access to a comprehensive API marketplace offering numerous APIs through a unified platform. These Terms govern your use of all APIVerve products, services, and features, including but not limited to:
2.1 Core Platform
- API Marketplace: Access to our catalog of APIs across various categories
- Developer Dashboard: Account management, API keys, usage analytics, and billing
- Documentation: API reference, guides, code examples, and tutorials
2.2 Developer Tools (VerveKit)
- AI Agent: Natural language interface for interacting with APIs
- JSON Bins: Cloud-based JSON storage and retrieval
- Mock Servers: Create mock API endpoints for testing and development
- API Playground: Interactive API testing environment
- Integrations: Connections to third-party platforms (Zapier, Make, etc.)
2.3 APIVerve Studio
APIVerve Studio is our desktop application for API testing and development. Studio may be used to test any API, including but not limited to APIVerve APIs. Use of Studio is subject to these Terms and any additional terms presented within the application.
2.4 Additional Services
- Customer support and technical assistance
- MCP (Model Context Protocol) server for AI integrations
- SDKs and client libraries
- Any other features, tools, or services we may introduce
We may modify, add, or discontinue features at any time. Material changes will be communicated via email or dashboard notification.
3. User Accounts and Registration
To access certain features of our service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs your use of APIVerve's APIs and services. Violation of this policy may result in suspension or termination of your account without refund.
4.1 Permitted Use
You may use our APIs to:
- Build and operate applications, websites, and services
- Integrate API functionality into your products
- Conduct legitimate business operations (paid plans only)
- Perform testing and development within your rate limits
4.2 Free Tier Restrictions
The free tier is provided for evaluation, testing, and non-commercial purposes only. If you are using the free tier, you agree to the following restrictions:
- Non-Commercial Use: Free tier access may not be used for commercial purposes, revenue-generating activities, or production applications serving end users
- Credit Limits: Free tier accounts receive a limited number of credits per month as specified on our pricing page. Credits expire monthly per Section 5.2
- Evaluation Period: The free tier is intended for evaluating our APIs before committing to a paid plan. Prolonged use without upgrading may result in account review
- No Resale: Free tier access may not be resold, redistributed, or shared with third parties
- Feature Limitations: Certain features, APIs, or higher rate limits may only be available on paid plans
To use APIVerve APIs for commercial purposes or production applications, you must upgrade to a paid subscription plan. We reserve the right to suspend or terminate free tier accounts that violate these restrictions. Free tier accounts exhibiting abusive patterns—such as repeatedly making API calls after credits are exhausted—may be blocked immediately without warning.
4.3 Technical Requirements
When using our APIs, you must:
- Respect rate limits and usage quotas for your plan
- Implement proper error handling and exponential backoff for retries
- Cache responses where appropriate to minimize unnecessary requests
- Keep your API keys secure and never expose them in client-side code
- Use HTTPS for all API communications
- Identify your application with a descriptive User-Agent header
4.4 Prohibited Activities
You may NOT use our service to:
- Illegal Activities: Conduct any activity that violates applicable laws, regulations, or third-party rights
- Abuse or Harassment: Harass, threaten, stalk, or harm any individual or entity
- Spam: Send unsolicited messages, advertisements, or promotional content
- Malware: Distribute viruses, malware, or other harmful code
- Fraud: Engage in fraudulent activities, phishing, or identity theft
- Data Harvesting: Scrape, collect, or store personal information without proper consent and legal basis
- Competitive Intelligence: Use our service to build a competing product or service
- Circumvention: Bypass, disable, or interfere with security features or access controls
- Overloading: Intentionally overload our systems or conduct denial-of-service attacks
- Unauthorized Access: Access accounts, systems, or data without authorization
- Impersonation: Misrepresent your identity or affiliation with any person or organization
4.5 Content Restrictions
You may not use our APIs to process, transmit, or store content that:
- Is illegal, defamatory, or infringes on intellectual property rights
- Contains child sexual abuse material (CSAM) or exploits minors
- Promotes violence, terrorism, or hate speech
- Contains explicit adult content without appropriate access controls
- Violates privacy rights or data protection laws
4.6 Resale and Redistribution
Without prior written consent from APIVerve:
- You may not resell, sublicense, or redistribute API access to third parties
- You may not create "wrapper" APIs that simply proxy our services
- You may not share API keys between separate organizations or entities
If you wish to resell or redistribute our APIs, please contact us to discuss partnership or enterprise arrangements.
4.7 Compliance
You are responsible for ensuring your use of our APIs complies with:
- All applicable local, state, national, and international laws
- Industry-specific regulations (HIPAA, PCI-DSS, etc.) if applicable to your use case
- Data protection laws (GDPR, CCPA, etc.) when processing personal data
- Export control laws and sanctions
4.8 Monitoring and Enforcement
We reserve the right to monitor API usage for compliance with this AUP. If we determine that you have violated this policy, we may:
- Issue a warning and request corrective action
- Temporarily suspend your API access
- Permanently terminate your account without refund
- Report illegal activities to appropriate authorities
- Take legal action to recover damages
Immediate Action Without Warning: We reserve the right to immediately block, throttle, or terminate API access without prior notice for abusive behavior, including but not limited to:
- Repeatedly hitting API endpoints after usage limits have been reached
- Patterns of requests that appear designed to circumvent rate limits
- Automated systems that continue making requests despite receiving error responses
- Any behavior that negatively impacts our infrastructure or other users
Free tier accounts are subject to stricter enforcement and may be blocked immediately for any suspicious or abusive patterns without warning. Paid accounts in good standing will generally receive notification before enforcement action, except in cases of severe abuse or security threats.
4.9 Reporting Violations
If you become aware of any violation of this AUP, please report it to us immediately via our contact page.
5. Billing and Payment
Our service operates on a credit-based pricing model. By using our services, you agree to:
- Pay all fees associated with your account usage
- Provide accurate billing information
- Update payment methods as needed
- Monitor your credit usage to avoid service interruption
5.1 Credit System
APIVerve uses a credit-based system where various actions consume credits (also referred to as "tokens" or "API calls"). Credit consumption varies by feature:
- API Calls: Each API request consumes credits based on the specific API and complexity of the request
- AI Agent: Interactions with the AI agent consume credits based on usage
- Developer Tools: JSON Bins, Mock Servers, and other VerveKit tools may consume credits based on usage and storage
- Other Features: Additional features may consume credits as specified in the dashboard or documentation
Current credit consumption rates are displayed in your dashboard and on our pricing page. We reserve the right to adjust credit consumption rates with reasonable notice.
5.2 Credit Expiration
Credits do not roll over. Unused credits expire at the end of each billing cycle and do not accumulate or carry over to subsequent periods. This applies to all plans, including free tier and paid subscriptions. Each billing cycle, your credit balance resets to your plan's allocated amount.
5.3 Overage and Additional Credits
If you exhaust your credits before the end of your billing cycle:
- API requests will be rejected until credits are replenished
- You may purchase additional credits or upgrade your plan
- Free tier users must upgrade to a paid plan to continue usage
5.4 30-Day Money-Back Guarantee
All paid subscription plans include a 30-Day Money-Back Guarantee. If you are not satisfied with our service, you may request a full refund within 30 days of your initial purchase. See our Refund Policy for complete terms.
5.5 Pricing Changes
We reserve the right to change our pricing structure, credit allocations, or consumption rates with 30 days' notice. Continued use of the service after changes constitutes acceptance of new rates. Existing subscriptions will be honored at their current rate until the next renewal.
6. Intellectual Property
6.1 Our Rights
APIVerve and its content, features, and functionality are owned by EvlarSoft LLC and are protected by copyright, trademark, patent, and other intellectual property laws.
6.2 Your Rights
You retain ownership of any content you create using our APIs. However, you grant us a license to use, modify, and display such content for service operation and improvement purposes.
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.
- We collect minimal personal information necessary for service operation
- We implement appropriate security measures to protect your data
- We do not sell personal information to third parties
- You have rights regarding your personal data as outlined in our Privacy Policy
7.1 Dashboard Analytics and Tracking Consent
By creating an APIVerve account, you expressly consent to full analytics and tracking within the authenticated dashboard environment. Unlike our public-facing websites where you can manage cookie preferences, the dashboard requires comprehensive tracking for the following operational purposes:
- Service Operation: Feature usage and navigation patterns to ensure functionality
- Performance Monitoring: API request metrics, response times, and error tracking
- Security: Session monitoring, access logging, and fraud detection
- Billing Accuracy: Usage metering to ensure accurate billing and quota enforcement
- Support: Diagnostic information to assist with troubleshooting and customer support
- Product Improvement: Analytics to identify areas for enhancement and prioritize features
This consent is a condition of using the dashboard and is based on both contractual necessity (we cannot provide accurate billing, security, or support without this data) and our legitimate interest in providing a reliable, secure, and continuously improving service.
The analytics tools used in the dashboard include Google Analytics, Microsoft Clarity, Mixpanel, and other services as described in our Cookie Policy. If you do not agree to this tracking, you should not create an account or use the dashboard.
7.2 Public Website Cookie Consent
On our public-facing websites—including apiverve.com and public subdomains such as docs.*, blog.*, studio.*, and API vertical sites—you can manage your cookie preferences using our consent banner. These preferences control analytics and marketing cookies on public pages. However, once you log into the dashboard, the consent described in Section 7.1 above applies.
8. Service Availability and Support
8.1 Uptime
We strive to maintain 99.9% uptime for our APIs but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects service availability.
8.2 Support
Support is provided via email and our dashboard. Response times vary by subscription level:
- Free tier: Best effort support
- Paid plans: 24-48 hour response time
- Enterprise: Priority support with faster response times
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
EvlarSoft LLC does not warrant that:
- The service will function uninterrupted, secure, or available at any particular time or location
- Any errors or defects will be corrected
- The service is free of viruses or other harmful components
- The results of using the service will meet your requirements
- Third-party APIs accessed through our platform will be accurate, reliable, or available
10. Limitation of Liability
To the maximum extent permitted by law, EvlarSoft LLC and APIVerve shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or business opportunities
- Service interruptions or delays
- Third-party API failures or changes
- Security breaches beyond our reasonable control
Our total liability for any claims related to the service is limited to the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless EvlarSoft LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:
- Your access to or use of the service
- Your violation of these Terms of Service
- Your violation of any third-party rights, including intellectual property rights
- Any content or data you transmit through the service
- Your negligent or wrongful conduct
12. Force Majeure
EvlarSoft LLC shall not be liable for any failure or delay in performing our obligations under these terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather events
- War, terrorism, riots, or civil unrest
- Government actions, laws, or regulations
- Power outages, internet or telecommunications failures
- Third-party service provider failures or outages
- Cyberattacks, including DDoS attacks or security breaches
- Epidemics, pandemics, or public health emergencies
In such events, our obligations will be suspended for the duration of the force majeure event, and we will use reasonable efforts to resume normal operations as soon as practicable.
13. Termination and Account Deletion
13.1 Termination By You
You may terminate your account at any time by submitting an account deletion request through your dashboard or by contacting us.
13.2 Account Deletion Process
To delete your account, submit a request through the support option in your dashboard. Upon processing your request:
- Your account and associated data are deleted immediately
- All API keys are revoked instantly and will stop working
- You will receive confirmation that deletion is complete
- Deletion is permanent and irreversible - your account cannot be recovered
13.3 Data Retention After Deletion
While your APIVerve account and personal data are deleted immediately, we retain certain records as required by law:
- Payment and billing records: Transaction history, invoices, and payment records are retained in our payment processor (Stripe) for tax compliance, accounting, dispute resolution, and legal requirements
- Anonymized usage data: Aggregated, non-identifiable data for analytics
- Legal records: Any records necessary to enforce our terms, comply with legal obligations, or defend against claims
13.4 Termination By Us
We may terminate or suspend your account immediately, without prior notice, if you:
- Violate these terms of service
- Engage in fraudulent or illegal activities
- Fail to pay required fees
- Abuse our systems or other users
13.5 Effect of Termination
Upon termination of your account:
- Your right to use the service ceases immediately
- No refunds will be issued for unused credits or remaining subscription time (except as provided in our Refund Policy)
- Provisions that by their nature should survive termination will remain in effect
14. Changes to Terms
We reserve the right to modify these terms at any time. When we make changes, we will:
- Post the updated terms on this page
- Update the "Last updated" date
- Notify users of material changes via email or dashboard notification
- Provide 30 days' notice for significant changes
Continued use of the service after changes constitutes acceptance of the new terms.
15. Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of law provisions. EvlarSoft LLC is headquartered in Lee's Summit, Missouri.
Any disputes arising from these terms or your use of the service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, except for:
- Claims for intellectual property infringement
- Small claims court matters within jurisdictional limits
- Requests for injunctive or equitable relief
The arbitration will be conducted in the Kansas City metropolitan area, Missouri, unless otherwise agreed by the parties. The arbitrator's decision will be final and binding.
16. Class Action Waiver
YOU AND EVLARSOFT LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Unless both you and EvlarSoft LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration section shall be null and void.

18. Severability
If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect, and the unenforceable provision will be replaced with an enforceable provision that most closely matches the intent of the original.
